Terms & Conditions: Join the CineD and FUJIFILM Team at the 2024 NAB Show

1. You must be aged 18 or over to enter the initiative (temporary recruitment). People (male/female/other) from all countries are eligible to enter and win.

2. Eligibility: Join the CineD and FUJIFILM Team at the 2024 NAB Show (the “Initiative”) is only open to those who sign up and submit their application via https://app.viralsweep.com/contest/full/0e4581-154709?framed=1. The Initiative is open worldwide and is void where prohibited by law. Employees, independent contractors, interns, officers, directors, and agents of FUJIFILM and CineD (the “Promoter”) their respective affiliates, subsidiaries, advertising and promotion agencies, suppliers, and their immediate family members and/or those living in the same household of each are not eligible to participate in the Initiative. The Initiative is subject to all applicable federal, state, and local laws and regulations. Void where prohibited.

3. To participate in this Initiative, entrants must share the link to their video and tell us why they are a good fit to work with the Promoter at the 2024 NAB Show. The Video must be publicly visible and not marked as private. The entrants can select the genre of their film freely. Each user is permitted one application per video. 

4. No purchase is necessary, however, you will need an internet connection and access the Promoter’s website and application link. No refund may be claimed for expenses incurred in participating in the promotion, including in relation to the use of the Internet.

5. Application Period: Applications can be handed in from March 11th, 05:00 PST to March 28th 23:59 PST. No applications will be accepted after this time. Promoter accepts no liability for any applications lost, delayed, or damaged in transmission.

6. How to Apply: The entrant must fulfill all requirements as specified, to be eligible to win. Hence, you need to submit your application using the form in Cine’D article (or follow this link: xxx), and share your name and the link to your video. It is not required, but kindly asked that you follow the Instagram accounts @CineDnews and @fujifilmx_us, and sign up for the CineD Newsletter, as well as the FUJIFILM Newsletter, to stay up to date. Applications that are incomplete or do not adhere to the rules or specifications of the Initiative may be disqualified at the sole discretion of the Promoter. You must provide the information requested. If you use fraudulent methods or otherwise attempt to circumvent the rules of the Initiative, your submission may be disqualified at the sole discretion of the Promoter.

7. By signing up for the CineD newsletter, as well as the FUJIFILM newsletter, you agree that CineD may give your personal information (name and e-mail address) to FUJIFILM and FUJIFILM only. You can unsubscribe from these e-mails separately at any time.

8. Prizes: The winners of the Initiative (the “winner”) will receive the following prizes:

• Two (2) winners will each get:
• 1x FUJIFILM X-H2S camera Body  (worth $2,499 at B&H retail price) + XF 18-120mm f/4 LM PZ WR Lens (worth $899 at B&H retail price)
• Working with the CineD & FUJIFILM team at the 2024 NAB Show with $100/day per diem as compensation (dates April 13th to April 17th, 2024)

Actual/appraised value of prizes may differ at time of prize award. The specifics of the prize shall be solely determined by the Promoter. No cash or other prize substitution shall be permitted except at the Promotor’s discretion. The prize is nontransferable. Substitution of the prize or transfer/assignment of the prize to others or request for the cash equivalent of the prize by the winner is not permitted. Any and all prize-related expenses, including without limitation any and all federal, state, and/or local taxes shall be the sole responsibility of the winner. Acceptance of the prize constitutes permission for the Promoter to use the winner’s name, likeness, and application for purposes of advertising and trade without further compensation unless prohibited by law.

In the event of a prize becoming unavailable, for whatever reason, the Promoter reserves the right to provide an alternative prize of similar or equivalent value. The cameras will be personally handed over by CineD at the 2024 NAB Show. 

9. If you are one of the lucky winners, your accommodation (5-star hotel: Conrad Las Vegas at Resorts World or equivalent) in Las Vegas in order to attend the 2024 NAB Show, is covered by the Promoter. Means of transportation to Las Vegas, however, are not included in the win, and must therefore be organized and paid by the entrant. 

10. In order to claim the prize, winners are obligated to attend and work with us at the 2024 NAB Show. If they fail to do so, they are disqualified. 

11. The winners are requested to sign a project contract before the beginning of the trade show. This contract is valid from April 13th to 17th 2024. The winners must present valid health insurance too, one that covers their stay or trip to the U.S. 

12. The CineD jury exists of CineD team members who will work at their sole discretion. The CineD jury will do a first selection of finalists based on the video work they shared and invite them to a second round. This second round will include online video interviews to get to know the entrants. The final two winners will be selected by the CineD jury and the announcement will take place April 5th, 2024.

13. The two winners will be announced on CineD.com, as well as on CineD’s social media channels on April 5th, 2024.

14. One application per person only is permitted in this Initiative. More than one application per person – either through the same or another Instagram account – will automatically lead to disqualification of all entries from the Initiative.

15. The Promoter reserves the right, at its sole discretion, to disqualify and remove any application that does not comply with these terms and conditions, even after a video is submitted. The Promoter also reserves the right to change the judging rules above at any time at its sole discretion, in which case all entrants will be notified via email.

16. You warrant and represent that, in respect of your application:

a) you are the sole owner and author of each video picture submission and own all rights to the images and footage;

b) each person depicted in the application has granted permission to be portrayed as shown;

c) it does not contain any infringing, threatening, false, misleading, abusive, harassing, libelous, defamatory, vulgar, obscene, scandalous, inflammatory, pornographic or profane content;

d) it does not infringe upon the copyrights, trademarks, contract rights, or any other intellectual property rights of any third person or entity, or violate any person’s rights of privacy or publicity, and does not include trademarks owned by third parties; copyrighted materials owned by third parties; names, likenesses, voices or other characteristics identifying celebrities or other public figures, living or dead;

e) you own the license of the music tracks used in your film (if any), and you and the Promoter have the right to publish and distribute that music as part of your film through the Internet globally and indefinitely;

f) you agree to fully indemnify the Promoter in respect of all royalties, fees, and any other monies owing to any person by reason of your breaching any of the terms detailed herein.

17. The Promoter reserves the right to remove and disqualify entries that contain commercial content in conflict with the interests of the Promoter.

18. By entering this Initiative you hereby grant the Promoter a non-exclusive worldwide royalty-free license to use, copy, modify, or alter any materials submitted in connection with the Initiative.

19. The Promoter assumes no responsibility and is not liable for any image or music misuse.

20. The Promoter assumes no responsibility for any incorrect, inaccurate, or incomplete information, whether caused by website users or by any of the equipment or programming associated with or utilized in the Initiative and the Promoter assumes no responsibility for technical, hardware or software failure of any kind, for lost network connections, garbled computer transmissions, other problems or technical malfunctions with regard to the Initiative.

21. The Promoter assumes no responsibility for any error, omission, corruption, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to or alteration of entries.

22. The Promoter is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, computer equipment, software, human error or traffic congestion on the internet or any website, or any combination thereof, including any injury or damage to your or any other person’s computer related to or resulting from participation or downloading any materials in the Initiative.

23. If for any reason an application cannot be viewed or is not capable of opening as planned, including infection by computer viruses, bugs, tampering, unauthorized intervention, fraud, or technical failures, the Promoter assumes no responsibility.

24. The Promoter will select the winning application. The judges’ decision will be final and no correspondence will be entered into.

25. If no response is received from the winners of the Initiative to the notification of their win after 48 hours, the Promoter reserves the right to award the prize to alternative winners.

26. There are no cash or credit alternatives available.

27. The winner agrees to participate in related publicity and to the use of their names and likenesses and the winning images for the purposes of advertising, promotion, and publicity across the world.

28. By entering the Initiative, you agree and acknowledge that the Promoter is permitted to receive your registration data. All personal information will be used by the Promoter in accordance with its Privacy Policy.

29. The Initiative is managed under the control of cinema5D GmbH (CineD). The rules are governed by the laws of Austria. By entering this Initiative you agree to submit to the laws of Austria in respect to the operation of the Initiative regardless of your country of residence.

30. This Promotion is in no way sponsored, endorsed, or administered by, or associated with Facebook, Instagram, or YouTube.

31. By entering the Initiative you hereby accept these terms and conditions, which are subject to change at any time.
